1.  For what purposes will yuxta use your Personal  Data?

The Personal Data we collect will be used for the following purposes, which are necessary for the provision of yuxta's services:

a. Main purposes

(i) To provide you with the services that  you have requested from yuxta; (ii) For using the  Platform; (iii) To identify and contact you during the  provision of services; (iv) To address your comments,  complaints and suggestions; and (v) To comply with  legal obligations and requirements of competent  authorities.  

In addition, we will use your personal information for the following purposes that are not necessary for the requested service, but that allow us to provide you with a better service:

b. Secondary purposes:

(i) To evaluate the quality of our service; (ii) To promote yuxta's services; (iii) To carry out marketing activities; (iv) To carry out advertising and promotional activities; and (v) To carry out statistical data analysis.

In the event that you do not want your Personal Data to be  processed for these secondary purposes, from this moment you  can let us know, following the process indicated in section VIII  (roman number eight) of this Privacy Notice. The refusal to use  your Personal Data for secondary purposes is not a reason for us  to deny you the services you contract with us. 

For the purposes mentioned above, yuxta may request one or  more of the following categories of Personal Data from you:

  • Contact information;  
  • Financial data;

  • Health data (see section "II"); and  
  • Ideological data (see section "II").

The Personal Data to which yuxta may have access varies  depending on the server, and privacy settings. The processing of  your Personal Data in yuxta is carried out in accordance with the  principles of legality, loyalty, information, consent, purpose,  proportionality, quality, and responsibility.  

  

yuxta is a company committed to the privacy of minors and  incapable people; therefore, we refrain from collecting and/or  processing, intentionally, the Personal Data held by them and has  not been obtained with the express consent of their parents,  guardians or legal representatives.  

  

If you are a parent, guardian or legal representative of a minor or  incapacitated person and you know that you have provided us  with Personal Data without your consent, you may request that  the Personal Data be deleted through the procedure and means  described in the following sections. 

2. Does yuxta collect Sensitive Personal Data?

In addition to the Personal Data mentioned above, yuxta may request, collect, process and/or use the following Personal Data considered as sensitive, which requires special protection:

a. Health Data

Information concerning a natural person related to the assessment, preservation, care, improvement and recovery of his physical or mental health, present, past or future, as well as genetic information.

  • Purpose: Being able to attend medical emergencies in case of incidents during the provision of services on-site. The information is   only kept for the period strictly necessary for the provision of the contracted services.

3. Where does the personal data we collect come from?

The Personal Data that yuxta process comes directly from the information You provide us when you access our Platform, request and/or receive our Services, or enter into any type of relationship with yuxta.

4. Can yuxta transfer your Personal Data?

Yes, in order to provide you with an adequate service, yuxta may transfer your Personal Data to the people indicated below. By accepting this Privacy Notice, during the time that your Personal Data is retained, you acknowledge and agree that Yuxta may communicate or give access to part or all of the Personal Data, without the need to request your authorization again, to:

a. Service providers:
Third parties that are contracted to act on behalf of yuxta, such as: (i) Companies or institutions engaged in the management and means of payment; (ii) Administrative, legal and/or accounting services; (iii) Computer systems providers, cloud services and technology service providers in general; (iv) Customer service centers; (v) Advertising or marketing agencies; (vi) Data analytics; (vii) Developers; (viii) Holding companies, subsidiaries, affiliates or corporately related to yuxta through which yuxta provides services; and (ix) Collection agencies. The information that will be provided to these providers will be solely and exclusively the necessary one for the proper performance of the Services they provide to yuxta.

b. Commercial allies:
Institutions or companies with which yuxta has signed a contract, in order to offer you a better service.

c. Authorities:
The administrative and judicial authorities that in the exercise of their competence require information, or when yuxta discretionally considers that there are sufficient grounds to assume the commission of any misdemeanor or crime.

yuxta will not communicate, transmit or transfer your Personal  Data to any recipient other than those mentioned in the preceding  paragraphs without your express or written authorization. In any  transfer of data, yuxta will only share information that is strictly  necessary for the fulfillment of its obligations and, in cases where  it does not affect the provision of services, yuxta will perform,  prior to the transfer of information, a process of data  anonymization.  

  

In this regard, if you do not express your opposition for your non sensitive Personal Data to be communicated to the Third Parties,  it will be understood that you have given your tacit consent.    

Yuxta does NOT transfer Sensitive Personal Data.

In the event that yuxta is acquired by a third party, the Personal  Data collected will be transferred to the acquirer of Yuxta. In that  case, the acquirer, as the new party responsible of processing  your Personal Data, will continue to maintain the necessary  administrative, technical and physical security measures to  ensure the privacy and protection of the Personal Data collected,  against damage, loss, alteration, destruction or unauthorized use, access or processing thereof in accordance with the provisions of this Privacy Notice. The foregoing in the understanding that the Holders must accept the new privacy policies.

5. What measures does yuxta employ for the  Protection of your Personal Data?

yuxta is obliged to treat all information collected under high  security measures, always ensuring your confidentiality,  therefore, all Personal Data collected will be stored in the  database or database storage and collection of information from yuxta, which has high security measures to protect the privacy  and protection of Personal Data collected against damage, loss,  alteration, destruction or unauthorized use, access or treatment  of them.  

  

Consequently, Personal Data is protected both online, through  encryption codes, and offline, since only the personnel  designated to perform a specific task with the Personal Data has  access to the Database. These procedures are constantly  evaluated and updated by yuxta.

6. For how long will yuxta keep your Personal Data?

Your Personal Data will be retained for as long as yuxta provides services to you. Once yuxta stops providing services to you, or your data is collected, whichever comes last, yuxta will keep your data for 5 (five) years thereafter, unless you request its deletion in accordance with the procedure set forth in paragraph VIII (roman number eight) below, in accordance with the safekeeping obligations required by the legislation in force.

7. What are your rights regarding your Personal Data?

Your rights, in relation to your Personal Data, are as follows:

  • The right to Access to your Personal Data;
  • The right to request its Rectification when it is inaccurate  or incomplete;
  • The right to Cancellation of their treatment;
  • The right to Object their treatment;
  • The right of Revocation of treatment;
  • The right to request the limitation of their treatment;
  • The right to the portability of your Personal Data; and
  • The right to file a complaint with a supervisory authority.    

If you gave us your consent for a specific purpose, you have the  right to withdraw your consent at any time, without affecting the  lawfulness of the processing based on the consent prior to its  withdrawal. 

8. How can you assert your rights?

To exercise any of the rights described above, you must:

  • Prepare a letter addressed to us (yuxta) stating: (i) your  full name; (ii) the e-mail address where yuxta can  respond to your request; (iii) what is your relationship  with yuxta and, (iv) a brief description of the facts,  including, as precisely as possible, what right you want  to assert and with respect to what data.
  • It is necessary that you indicate to us, in addition to the  above, the modifications that need to be made and  provide the documentation supporting your request.
  • Your letter must be accompanied by a simple copy of  the documents that prove your identity or, if applicable,  the legal representation of the Holder.

You must send your letter to the following e-mail address:  enroll@inspirationexcursions.com to the "Personal Data  Department".  

  

Once we receive your request, we will confirm its reception to the  email address you have indicated in your letter. From the day we  confirm the reception of your request, yuxta will have a maximum  of 20 (twenty) business days to respond, so that, if it is  appropriate, it will be effective within 15 (fifteen) business days  following the date on which the response is communicated.  

  

The aforementioned terms may be extended only once for an  equal period, as long as the circumstances of the case justify it.

9. How can you stop receiving advertising messages  from yuxta?

yuxta may send you e-mails containing advertising messages, which you may opt-out of receiving at any time by clicking on the link "I do not want to receive any more such e-mails" link embedded in such e-mails sent by yuxta.

10. Are there any automated decisions, profiling or logic  applied in relation to your Personal Data?

You are informed that in the processing of your Personal Data there are no automated decisions and profiles may be developed  where an applied logic is required.

11. Does yuxta use cookies and web beacons?

It is important to mention that our Site makes use of cookies, web  beacons, through which it is possible to analyze the behavior of Internet users within our portal, in order to provide you with a better service and experience when browsing our site. As well as offering you services based on your preferences. The Personal and/or Sensitive Data that we collect through these technologies will be used for the following purposes:

  • Analysis and statistics of our web site.  
  • Improve the service, quality and performance of our web  site.

This Privacy Notice constitutes a legal agreement between you  (the Owner) and yuxta. By using the services of this Web  Platform, you signify that you have read, understood and  consented to the terms set forth above.  

  

This Privacy Notice may be modified, changed or updated as a  result of new legal requirements, our own needs for the services  we offer, our privacy practices, or changes in our operating model  or other causes.
